Acceptance of Terms
Welcome to the HARM platform. These Terms and Conditions ("Terms") govern your access to and use of the HARM platform and services ("HARM" or the "Platform"), operated by HARM Inc. By accessing or using HARM, you agree to these Terms and to our Privacy Policy (which is incorporated into these Terms by reference). If you do not agree with any part of these Terms or the Privacy Policy, do not use the Platform. Using HARM indicates that you accept and will abide by these Terms.
These Terms form a binding legal agreement between you and HARM Inc. regarding your use of the Platform. You acknowledge that you are entering into this agreement with HARM Inc. If you have any questions about these Terms, please contact us using the information provided at the end of this document.
Description of Services and Disclaimers
HARM is a survivor-led, AI-assisted system that provides guidance and connections to vetted resources for individuals experiencing harm. The Platform uses artificial intelligence to offer supportive information, suggest helpful resources, and allow users to join a waitlist for future services (HARM v2). However, it is important to understand the following about HARM's services:
Not an Emergency Service: HARM is not a replacement for 911 or any emergency service. The Platform cannot contact emergency responders on your behalf. If you are in immediate danger or require urgent assistance, call 911 or your local emergency number. HARM is not a crisis hotline, and we do not provide real-time emergency intervention.
No Professional Advice: While HARM's AI strives to provide helpful guidance, it is not a licensed medical, legal, or therapeutic professional. Any information or support provided by the AI is for informational and supportive purposes only and is not a substitute for professional medical, legal, or therapeutic advice or diagnosis. You should consult qualified professionals for advice specific to your circumstances.
AI Guidance, Not Human Advocacy: Interactions on HARM are with an AI assistant, not a human counselor or advocate. The AI can offer empathy, information, and resource suggestions, but it cannot replicate the personalized judgment or expertise of a trained human professional. There is no doctor-patient, attorney-client, or therapist-client relationship created by your use of HARM.
No Guarantee of Outcomes: HARM Inc. makes no guarantee that using the Platform will result in any particular outcome or solution to your situation. We provide suggestions of resources or referrals based on the information available, but we do not promise that: (a) the information is completely accurate or tailored to your needs, (b) any third-party resource will be available or able to assist you, or (c) your use of a referred service will achieve a specific result. You use the Platform at your own discretion and risk, and you are responsible for any decisions or actions you take based on the guidance provided.
User Conduct and Requirements
Age Requirement (13+)
You must be at least 13 years old to use HARM. The Platform is not intended for children under 13, and we do not knowingly collect personal information from anyone under 13 years of age in compliance with the U.S. Children's Online Privacy Protection Act (COPPA). By using HARM, you represent and warrant that you are 13 or older. If you are under 13, do not use this Platform. If we learn that a person under 13 has used the Platform or provided personal information, we will delete such information and may terminate the user's access.
User Conduct and Prohibited Uses
We expect all users to use HARM in a respectful and lawful manner. You agree not to misuse the Platform or help anyone else do so. Specifically, you agree that you will not:
Harass, threaten, or harm any person, or encourage others to do so, through your use of HARM. This includes using abusive language or sharing content that is defamatory, obscene, or hateful.
Impersonate any person or entity, or misrepresent your identity or affiliation. You must be honest about who you are; do not use the Platform to deceive others.
Submit any content or information that is illegal, obscene, pornographic, violent, discriminatory, or otherwise offensive. This includes content that infringes on others' rights (such as someone's intellectual property or privacy).
Use the Platform for any commercial purpose not authorized by us. For example, you will not use HARM to advertise or sell products/services, to spam others, or to conduct surveys or contests without permission.
Attempt to disrupt or interfere with the Platform's proper functioning. Do not introduce viruses, malware, or any other harmful code. Do not attempt to hack, attack, or overload our network or servers.
Reverse engineer, decompile, or otherwise attempt to extract the source code or underlying algorithms of any part of the Platform, especially the AI system. The technology that powers HARM is proprietary, and you agree not to tamper with it.
Violate any applicable laws or regulations in your use of HARM. You are responsible for your own actions on the Platform and ensuring those actions are lawful where you are located.
These rules are in place to keep HARM a safe and helpful space for everyone. If you engage in any of the above prohibited activities (or any other behavior we deem harmful, unlawful, or in violation of the letter or spirit of these Terms), we may take action including warning you, removing content, or terminating your access to HARM.
Waitlist Terms
HARM Inc. may offer a waitlist for users interested in upcoming features or the next version of the Platform (e.g., "HARM v2"). By signing up for our waitlist, you agree to the following terms:
Email Collection: When you join the waitlist, we will ask for your email address (and possibly limited additional info, such as name or region). We use this information only to record your place on the waitlist and to communicate with you about HARM updates.
Purpose of Waitlist: The waitlist allows us to manage interest in HARM v2 and roll out access in stages. It does not guarantee that you will receive access to the new platform or any specific feature.
Communications: By joining the waitlist, you consent to receive emails from us about the HARM platform. You can opt-out of waitlist emails at any time.
No Fees: Joining the waitlist is free. We will not ask you for payment information to join the waitlist.
Data Usage: The email and any info you provide for the waitlist will be protected in line with our Privacy Policy.
Intellectual Property
All rights, title, and interest in and to the HARM Platform and all content made available through it are owned by HARM Inc. or its licensors. This includes (but is not limited to) the software, AI models, text, graphics, logos, design, trademarks, and the compilation of content on the Platform.
Limited License
HARM Inc. grants you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Platform for your own personal, non-commercial purposes, and in accordance with these Terms. This license does not allow you to copy, modify, distribute, publicly perform or display, license, or create derivative works of any content on the Platform.
User-Provided Content
In general, HARM does not require you to post content publicly. We claim no ownership over the personal stories or scenarios you share with the AI. However, by submitting any content (such as feedback, suggestions, or testimonials) to HARM Inc., you grant HARM Inc. a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, and display that content solely for the purpose of operating, improving, or promoting the Platform.
Third-Party Referrals and Links
As part of its service, HARM's AI may provide you with referrals or links to third-party resources. We want to clarify how these referrals work and our relationship to them:
No Endorsement or Control: HARM Inc. does not own or control third-party services. We cannot guarantee the accuracy of information on their websites or the quality of assistance they provide.
Partner Vetting: We endeavor to vet our partner organizations to verify that referred resources are legitimate and reputable.
Consent Before Sharing Data: We will not share your personal information with any third-party resource without your explicit consent.
Third-Party Terms: Any third-party service you engage with will have its own Terms and Conditions and Privacy Policy.
Termination and Suspension
HARM Inc. reserves the right to suspend or terminate your access to the Platform at any time, for any or no reason, and with or without prior notice. We may take such action if we reasonably believe that: (a) you have violated these Terms or any applicable law; (b) you have misused the Platform or behaved in a way that is harmful to other users, our AI, or our partners; or (c) it's necessary to protect the safety, security, or integrity of the Platform or others.
If your access is terminated or suspended, you must stop using the Platform immediately. Users are free to stop using HARM at any time. Even after termination of your access, certain provisions of these Terms will continue to apply.
Disclaimers and Limitation of Liability
Disclaimers of Warranty
The HARM Platform and all services and information provided through it are provided "as is" and "as available". HARM Inc. makes no warranties or representations of any kind regarding the Platform. To the fullest extent permitted by law, we disclaim all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, HARM Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of (or inability to use) the Platform. In no event shall HARM Inc.'s total cumulative liability to you exceed the amount (if any) that you have paid to HARM Inc. for access to the Platform in the 12 months preceding the event giving rise to liability.
No Guarantee of Outcomes
You acknowledge that HARM's role is to support and provide information, but not to guarantee results. Any actions you take based on information from the Platform are solely at your own risk.
Indemnification
You agree to indemnify, defend, and hold harmless HARM Inc. and its affiliates from any and all claims, demands, lawsuits, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) that arise out of or relate to: (a) your use or misuse of the Platform; (b) your violation of these Terms; (c) your violation of any law or regulation; or (d) your infringement or violation of any rights of another party.
Arbitration Clause
Agreement to Arbitrate
You and HARM Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform will be resolved through binding arbitration on an individual basis (not in court), except as provided below or where prohibited by law.
Class Action Waiver
All disputes must be pursued on an individual basis. You and HARM Inc. agree not to bring or participate in any class action or other representative proceeding against each other.
Opt-Out
If you do not wish to be bound by this arbitration agreement, you have the right to opt out. To do so, you must notify us in writing within 30 days of first accepting these Terms.
YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS SECTION (ARBITRATION CLAUSE), AND THAT YOU UNDERSTAND YOU ARE GIVING UP THE RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL FOR ANY COVERED CLAIMS.
Governing Law
These Terms and any dispute or claim arising out of or related to them or the use of the Platform are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Subject to the Arbitration Clause above, if any matter arises that is not subject to arbitration, then it shall be brought in the state or federal courts located in the State of Delaware.
Changes to Terms
We may modify or update these Terms from time to time. HARM Inc. reserves the right to change these Terms at our discretion, but if we do, we will notify users by updating the "Effective Date" at the top of this document. In the case of material changes, we will also take reasonable steps to notify you in advance.
It is your responsibility to review the Terms periodically. If you continue to use HARM after the new Terms take effect, that will constitute your acceptance of the changes.
